These Terms of Service ("Terms") govern your access to and use of SmartDM (the "Service"), operated by Manne and Co. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SmartDM is a software platform that lets Instagram Business and Creator accounts automate and manage direct messages and comments, build conversation flows, publish content and collaborate as a team, using Meta's official APIs.
2. Eligibility & accounts
You must be at least 16 years old and able to enter into a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account.
3. Connecting Instagram accounts
To use automation features you connect one or more Instagram Business or Creator accounts through Meta's OAuth login. You confirm that you are authorised to manage each connected account and that your use complies with the Instagram Terms of Use and the Meta Platform Terms.
4. Acceptable use
You agree not to use the Service to: send spam, unsolicited or deceptive messages; violate Instagram's or Meta's policies; harass or harm others; infringe intellectual property; or break any applicable law. We may suspend or terminate accounts that breach these rules or that put our Meta platform access at risk.
5. Your content
You retain all rights to the content and messages handled through the Service. You grant us a limited licence to process that content solely to operate the Service for you. You are responsible for the messages and automations you create.
6. Availability & changes
We work to keep the Service available but do not guarantee uninterrupted access. The Service depends on third-party platforms (notably Meta) whose APIs and policies may change, which can affect features. We may modify, suspend or discontinue features at any time.
7. Fees
Some plans may be paid. Applicable prices, billing cycles and refund conditions are presented before you subscribe. Taxes may apply. Where the Service is offered free of charge, it is provided "as is".
8. Termination
You can stop using the Service and delete your account at any time (see the Data Deletion Instructions). We may suspend or terminate your access if you breach these Terms or for legal/security reasons.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We are not responsible for actions taken by Meta/Instagram on your account, nor for content you send through the Service.
10. Limitation of liability
To the maximum extent permitted by law, Manne and Co shall not be liable for any indirect, incidental or consequential damages, or for loss of data, profits or revenue, arising from your use of the Service.
11. Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy.
12. Governing law
These Terms are governed by the laws applicable at the registered seat of Manne and Co, without prejudice to mandatory consumer-protection rules of your country of residence.
13. Changes to these Terms
We may update these Terms. The updated version will be posted on this page with a new "Last updated" date. Continued use after changes constitutes acceptance.
